Geneva has no fixed number of notaries: about fifty work in some twenty private offices, appointed by the Council of State. Candidates must be Swiss, at least 25, hold a law degree, complete a traineeship of more than four years and pass a state examination. They are public officers without being state employees, and a supervisory commission named by the Council of State oversees them (Geneva Chamber of Notaries, checked )(Geneva Chamber of Notaries, checked ).
The official tariff (REmNot) charges a property transfer deed 7 per mille of the value up to CHF 200,000 (minimum CHF 200), 6 per mille from CHF 200,001 to 400,000, 4.5 per mille from CHF 400,001 to 800,000 and 4 per mille up to CHF 1 million. The bill must list fees, honoraires and disbursements separately, and a dispute goes by simple letter to the clerk of the Tribunal de première instance, free of charge (REmNot E 6 05.03, checked ).
The Chamber of Notaries holds a Permanence at rue Verdaine 13 on Thursdays, with 30-minute consultations for CHF 60 and no appointment; it does not draw up deeds or legalise signatures (Geneva Chamber of Notaries, checked ). For use abroad, the OCPM legalises signatures and affixes the apostille for CHF 30 (Canton of Geneva, checked ). Employment disputes are heard by the Tribunal des prud’hommes, whose conciliation stage costs nothing and whose proceedings are free up to CHF 75,000 (Geneva judiciary, checked ).
